As a criminal defense attorney, I handle DUI cases as well as all gun related charges. It is common to end up handling both areas of the law at the same time.
There is a very seldom used Florida Statute 790.151. All should be aware that using a firearm while under the influence of alcoholic beverages, chemical substances, or controlled substances is a crime in this state.
If you are under the influence (loaded) and are holding a loaded gun in your hand, you can be prosecuted for second degree misdemeanor, which is punishable by maximum of 60 days in the county jail.
Just remember, if you are loaded, don’t hold a loaded gun… all I am saying.
