Florida DUI Penalties by Offense

First DUI Offense - Fines: $500-$1,000 (up to $2,000 if BAC is .15 or higher) - Jail: Up to 6 months (up to 9 months with high BAC) - License suspension: 180 days to 1 year - Community service: 50 hours mandatory - DUI school: Required completion

Second DUI Offense - Fines: $1,000-$2,000 - Jail: Up to 9 months (mandatory 10 days if within 5 years) - License suspension: Minimum 180 days, up to 5 years

Third DUI Offense (Within 10 Years) - Classification: Third-degree felony - Prison: Up to 5 years - License revocation: Minimum 10 years

The 10-Day Rule

After a DUI arrest, your license is automatically suspended. You have only 10 calendar days to request a formal review hearing with the Florida DHSMV.
